4. HOW DO I WIN?
The first 500 valid entries received by CamelBak® by October 31, 2009 will receive the CamelBak® insulated stainless Better Bottle™ (a $30 value).
5. HOW DO I FIND OUT WHAT I WON?
Winners will be notified via e-mail. If a winning contestant cannot be officially notified and eligibility verified within 28 days, another winner will be selected and the process will begin again. Any potential prize winner who declines to accept the prize, has violated any of these Official Rules, does not respond to the award notification by the date listed on the notification, or is found to be ineligible will be disqualified and an alternative potential prize winner shall be chosen. Each potential winner may be required to sign/return an Affidavit of Eligibility and Liability/Publicity Release within 14 days of notice or they will be disqualified and an alternative prize winner shall be chosen. The winner releases Sponsor, their affiliated companies, and all employees, agents, and representatives from any and all liability and responsibility of any kind which is related in any way to the prize (including without limitation any property loss, damage, personal injury or death) and consent to the use of their names and likenesses for advertising and promotional purposes without additional compensation, except where prohibited by law.
6. GENERAL CONDITIONS
Winning contestant will allow CamelBak & participating sponsors to use their name and likeness for promotional purposes. Void where prohibited. This contest is subject to all applicable Federal, State and local laws and regulations. By entering, each entrant agrees to be bound by these Official Rules and the decisions of Sponsor, whose decisions are final and binding with respect to all matters related to this promotion. Sponsor is not responsible for any printing errors in these Official Rules.
7. HOW WILL DISPUTES BE HANDLED?
Each entrant agrees that (1) any and all disputes, claims, and causes of action arising out of or in connection with this promotion, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in Sonoma County, California; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this promotion, but in no event attorneys' fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with this promotion, shall be governed by, and construed in accordance with the laws of the State of California, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of California or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the State of California.
